By accessing or using any Built-Simple.ai API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all Built-Simple.ai APIs including but not limited to:

FixIt API (Stack Overflow Search)
PubMed API (Medical Research Search)
Wikipedia API (Hybrid Search)
ArXiv API (Academic Paper Search)

2. Description of Service

Built-Simple.ai provides API access to search databases containing publicly available information. Our APIs enable developers and businesses to integrate search functionality into their applications.

The Service includes:

RESTful API endpoints for search queries
Authentication via API keys
Rate-limited access based on subscription tier
Documentation and support resources

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account by providing a valid email address. You may also authenticate using Google OAuth where available.

3.2 API Keys

Upon registration, you will receive an API key. You are responsible for:

Keeping your API key confidential
All activity that occurs under your API key
Notifying us immediately of any unauthorized use

3.3 Account Security

You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Not share your API key with third parties
Not create multiple free accounts to circumvent usage limits

4. Subscription and Billing

4.1 Free Tier

100 API requests per month
No credit card required
Subject to rate limiting

4.2 Pro Tier

10,000 API requests per month
$29 USD per month
Billed monthly via Stripe
Cancel anytime

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information on our servers.

4.4 Billing Cycle

Subscriptions are billed on a monthly basis starting from the date of initial subscription. You will be charged at the beginning of each billing cycle.

5. Usage Limits

5.1 Rate Limiting

API requests are subject to rate limiting:

Free tier: 100 requests per month
Pro tier: 10,000 requests per month
Burst limits may apply to prevent abuse

5.2 Exceeding Limits

If you exceed your usage limits:

Free tier: Requests will be rejected until the next billing cycle
Pro tier: Contact us for additional capacity

6. Prohibited Uses

You agree NOT to use the Service to:

Scraping: Systematically download or store large portions of the database
Resale: Resell, redistribute, or provide API access to third parties
Abuse: Attempt to overwhelm, disrupt, or damage the Service
Circumvention: Bypass rate limits or authentication mechanisms
Illegal Activity: Engage in any activity that violates applicable laws
Reverse Engineering: Attempt to reverse engineer the Service
Misrepresentation: Falsely claim affiliation with Built-Simple.ai
Automated Abuse: Use bots or scripts to create multiple accounts

7. Intellectual Property

7.1 Service Ownership

Built-Simple.ai owns all rights, title, and interest in the Service, including all software, APIs, documentation, and trademarks.

7.2 Data Sources

The data accessible through our APIs is sourced from publicly available databases:

Stack Overflow content is licensed under CC BY-SA
PubMed content is from the National Library of Medicine
Wikipedia content is licensed under CC BY-SA
ArXiv content is subject to individual paper licenses

7.3 Attribution Requirements

When using data from our APIs, you must comply with the attribution requirements of the underlying data sources.

7.4 Your Content

You retain ownership of any content you submit through the Service. By using the Service, you grant us a limited license to process your queries for the purpose of providing the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF DATA
UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

The Service will meet your requirements
The Service will be available at all times
Results will be accurate or reliable
Errors will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILT-SIMPLE.AI SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or business opportunities
Damages arising from your use or inability to use the Service
Damages arising from unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Built-Simple.ai and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your violation of applicable laws

11. Termination

11.1 By You

You may terminate your account at any time by:

Canceling your subscription through your account settings

11.2 By Us

We may suspend or terminate your access to the Service:

For violation of these Terms
For suspected fraudulent or abusive activity
For non-payment of fees
At our sole discretion with reasonable notice

11.3 Effect of Termination

Upon termination:

Your right to use the Service will immediately cease
Your API key will be deactivated
You will not be entitled to any refund of prepaid fees
Provisions that should survive termination will remain in effect

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending an email to registered users

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

Good faith negotiation
Binding arbitration in accordance with the rules of the American Arbitration Association
The prevailing party shall be entitled to reasonable attorneys' fees

15. Miscellaneous

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Built-Simple.ai regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our prior written consent.
